Hotel Das Zeit – as of 01/03/2023
1. Scope of Application
1.1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern all services provided by F5 Hotelbetriebs GmbH, Johann-Böhm-Straße 19, 4860 Lenzing, operating the Hotel Das Zeit at Kreuzstraße 30, 4860 Lenzing (hereinafter referred to as “Hotel Das Zeit”), to the hotel guest, the event organizer, travel agency, and any other contracting party (hereinafter referred to as the “Contracting Party”).
1.2. Services within the meaning of these GTC include, in particular, paid accommodation of guests and groups, the organization and rental of premises (meetings, seminars, conferences, celebrations, corporate events, and other events), the sale of food and beverages, and all other services associated therewith.
1.3. In the event of any conflict between these GTC and the terms and conditions of an offer signed by the customer or confirmed in writing (including by email), the provisions of the offer shall prevail.
1.4. The Contracting Party undertakes to comply with these terms and conditions as well as all other regulations applicable to it. It is expressly agreed that the Contracting Party’s own general terms and conditions shall not apply and therefore do not need to be expressly rejected by Hotel Das Zeit at any time.
1.5. For matters not governed by these GTC, the Austrian Hotel Industry General Terms and Conditions (2006) shall apply as supplementary provisions to fill any gaps.
1.6. Should any individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
1.7. Place of performance and place of payment is Lenzing. Austrian law shall apply. Exclusive jurisdiction is Wels.
2. Conclusion of Contract, Prices, General Provisions
2.1. The accommodation contract is concluded upon acceptance of the offer by the Contracting Party and the subsequent transmission of the booking confirmation by Hotel Das Zeit. Reservations, contract amendments, and cancellations generally require written form; electronic transmission is permitted. Telephone or verbal agreements regarding reservations, changes, cancellations, price changes, etc. shall only become valid once confirmed in writing by Hotel Das Zeit.
2.2. Prices are generally stated in euros and include all taxes and duties. Local taxes are listed separately. Any price changes due to taxes and duties shall be borne by the Contracting Party.
2.3. Hotel Das Zeit is entitled at any time to request an interim invoice or an invoice for the total services.
2.4. Hotel Das Zeit is entitled to conclude the accommodation contract subject to an advance payment by the Contracting Party. The required amount of the advance payment must be expressly stated by Hotel Das Zeit in the booking confirmation or confirmation letter. Unless otherwise agreed, advance payments of 45% are due upon confirmation of the reservation and a further 45% no later than 14 days before the day of arrival.
2.5. Advance payments are deemed part payments of the agreed remuneration. The Contracting Party shall bear the costs of the money transfer in any case. For credit and debit cards, the respective terms and conditions of the card companies apply.
2.6. By concluding the accommodation contract, the Contracting Party acquires the right to the customary use of the rented premises and those facilities of Hotel Das Zeit that are normally accessible to guests for use without special conditions. The Contracting Party shall exercise its rights in accordance with any applicable hotel and/or guest guidelines and house rules.
2.7. Unless otherwise agreed, the premises booked by the Contracting Party will be available from 3:00 p.m. on the agreed day of arrival. Earlier occupancy requires prior confirmation by Hotel Das Zeit and may be charged separately as an early check-in fee. If a room is used on the day of arrival before 6:00 a.m., the preceding night already counts as an overnight stay. On the agreed day of departure, the Contracting Party must vacate the booked premises no later than 11:00 a.m. and return the issued key cards to reception. Upon request, a late check-out may be arranged for a fee. If the booked premises are not vacated on time, Hotel Das Zeit is entitled to charge an additional full day.
2.8. Hotel Das Zeit has the right to provide the services owed under the accommodation contract in an equivalent hotel operation. Hotel Das Zeit will only assume any additional costs arising from this if they are attributable to its sphere of responsibility. Any additional costs resulting from special requests by the Contracting Party shall be borne by the Contracting Party.
2.9. Any transfer of rights arising from the contractual relationship between the Contracting Party and Hotel Das Zeit—whether for consideration or free of charge—requires the express written consent of Hotel Das Zeit.
3. Cancellations
3.1 If the accommodation contract and/or booking confirmation provides for an advance payment and the Contracting Party fails to make such payment by the due date, Hotel Das Zeit may withdraw from the accommodation contract without granting a grace period.
3.2 Unless otherwise stipulated in the booking confirmation or the accommodation contract, bookings at the Standard Rate (Bestflexible) may be cancelled free of charge up to no later than 24 hours before the day of arrival (12:00 a.m.). In the event of non-arrival (no-show), cancellation outside the agreed cancellation period, as well as for bookings at the non-cancellable Advanced Rate, 100% of the booked accommodation price for the nights as stated in the booking confirmation will be charged. It is expressly noted that illness or other reasons preventing arrival do not entitle the guest to a free cancellation. In such cases, taking out private travel insurance is recommended.
3.3. The cancellation or no-show fee is due immediately on the first day of the booked stay. If advance payments have been made, they will be offset against this fee; any overpayment will be refunded to the account provided by the Contracting Party. If credit cards have been provided as security, the Contracting Party hereby expressly agrees to being charged by Hotel Das Zeit to the extent stated above in section 3.2.
4. Liability of Hotel Das Zeit
4.1. Hotel Das Zeit shall be liable for valuables brought in by hotel guests up to a maximum amount equal to the insured sum under the hotel’s liability insurance policy. Items of personal, everyday use—such as clothing, shoes, cosmetics, or electronic devices (including mobile phones, laptops, and tablets)—are not considered valuables and therefore will not be reimbursed by Hotel Das Zeit. Hotel Das Zeit shall also not be liable for valuables such as jewelry, personal documents, securities, and cash that are stored locked in the in-room safe.
4.2. As a rule, Hotel Das Zeit does not accept any valuables for safekeeping in the hotel safe.
4.3. Items left behind by the Contracting Party will be kept at Hotel Das Zeit for a maximum of 14 days after departure, provided they have an apparent value of at least EUR 10.00. Upon request, the items will be sent to the Contracting Party at the Contracting Party’s own risk and expense. If the items have no apparent value or are not collected, they will be disposed of.
4.4. Use of the public internet access at Hotel Das Zeit is provided free of charge. Defective operation or an outage of the internet connection shall neither constitute grounds for a reduction of the invoice nor give rise to any liability or claims for damages against Hotel Das Zeit.
4.5. Hotel Das Zeit assumes no liability for accidents during events. In general, towards consumers—except in cases of personal injury—Hotel Das Zeit shall not be liable for slight negligence. Towards entrepreneurs, Hotel Das Zeit shall generally only be liable in cases of gross negligence and intent, with the burden of proof resting with the entrepreneur. No liability shall exist for consequential damages, non-material damages, or loss of profit.
4.6. Liability for items lost by the Contracting Party, its employees, agents, visitors, or guests is excluded, including in the event of theft, burglary, or fire damage. Any corresponding insurance must be taken out by the Contracting Party itself.
4.7. Any claims against Hotel Das Zeit must be asserted in writing within 3 months; otherwise, they shall lapse.
5. Withdrawal and Termination
5.1. Hotel Das Zeit is entitled at any time, without prejudice to its claim for payment, to withdraw from the contract with the Contracting Party with immediate effect if there is an objectively justified reason.
5.2. Objectively justified reasons include, in particular, if:
5.2.1. the Contracting Party fails to make a due payment even after being granted a grace period of 7 days;
5.2.2. insolvency proceedings are opened against the Contracting Party’s assets or are rejected due to a lack of assets sufficient to cover costs;
5.2.3 the Contracting Party jeopardizes the smooth operation of the business, the safety, or the reputation of Hotel Das Zeit or its guests, without this being attributable to Hotel Das Zeit’s sphere of control or organization;
5.2.4 required official permits are not provided or the event is prohibited by the authorities;
5.2.5. performance of the contract becomes impossible due to force majeure, strikes, serious economic reasons, or other circumstances for which Hotel Das Zeit is not responsible;
5.2.6. the Contracting Party provides misleading or false information or conceals facts essential to the contract; facts essential to the contract may include the identity of the Contracting Party or its guests, its ability to pay, or the purpose of the event.
5.2.7 the purpose or occasion of the event is unlawful.
5.3. If Hotel Das Zeit exercises its right of withdrawal for the reasons stated above, the Contracting Party shall be obliged to pay damages and compensation for lost profit. In such cases, any liability of Hotel Das Zeit is excluded.
6. Data Protection
6.1. Due to the specific nature of accommodation services, the storage and disclosure of personal data is essential. The Contracting Party acknowledges that it must provide Hotel Das Zeit with the personal data required to deliver the agreed services and accepts that personal data may be disclosed for the proper performance of the ordered services to booking platforms used for booking tourism services, service providers that render tourism-related or other services, as well as public bodies and authorities for registration-related purposes, duties and taxes, and other legally mandated purposes.
6.2. If personal data is not provided by the data subject themselves but by representatives of the Contracting Party, the Contracting Party is obliged to inform the data subject of the information set out in section 6.1.

7. Special Rules for Stays and Fees
7.1. Smoking is strictly prohibited anywhere inside the Hotel Das Zeit building and is only permitted outdoors in the designated zones equipped with ashtrays. In the event of non-compliance, a cleaning fee of EUR 180.00 will be charged in any case. In addition, for extraordinary soiling of any rooms at Hotel Das Zeit caused by the Contracting Party or accompanying persons, a cleaning fee of at least EUR 150.00 per affected room will be charged. If the affected rooms cannot be used or rented out, Hotel Das Zeit also reserves the right to claim any further loss of earnings associated with this.
7.2 Willful damage to hotel inventory or hotel facilities, as well as any damage caused by the circumstances listed in section 7.1, will be recharged to the Contracting Party in the amount of the respective replacement value. The same applies in the event of theft of hotel property, which will also be reported to the authorities. In addition to the replacement value, a general processing fee of up to EUR 250.00 will be charged for thefts. Repair work will be charged according to the time spent, but at least at a minimum flat rate of EUR 90.00.
7.3. Fahrlässig oder mutwillig ausgelöste Feueralarme (z.B. durch Rauchen auf dem Hotelzimmer) und Feuerwehreinsätze werden mit bis zu EUR 500,00 verrechnet.
7.4. Bringing pets is not permitted at Hotel Das Zeit.
